1. Acceptance of Terms

By accessing or using InbXr at inbxr.us ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We may update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.

2. Service Description

InbXr provides email deliverability analysis tools, including but not limited to:

• Email content and header analysis
• SPF, DKIM, and DMARC authentication checking
• Inbox placement testing across major email providers
• Subject line scoring and optimization
• BIMI record verification
• Blacklist monitoring
• Email address verification
• Domain warm-up tracking
• DNS record generation

The Service is provided as a diagnostic and informational tool. Results are based on automated analysis and should be used as guidance, not as a guarantee of email delivery.

3. Account Responsibilities

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and current registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to use InbXr to:

• Send, facilitate, or promote unsolicited bulk email (spam)
• Test or optimize emails intended for phishing, fraud, or deception
• Attempt to circumvent rate limits, access controls, or security measures
• Scrape, crawl, or programmatically access the Service without authorization (API access is available on eligible plans)
• Interfere with or disrupt the Service or its infrastructure
• Use the Service in any way that violates applicable laws, including CAN-SPAM, GDPR, or other anti-spam and data protection regulations
• Share, resell, or redistribute your account access to unauthorized parties

Violation of this policy may result in immediate account termination without refund.

5. Payment Terms

Free Tier: InbXr offers a free tier with limited daily usage. No payment is required for free accounts.

Paid Subscriptions: Paid plans (Pro, Agency) are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Pricing Changes: We may change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.

Refund Policy: Subscriptions can be canceled at any time from your Account page. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods. If you experience a billing error, contact us at inboxermedia@gmail.com and we will work to resolve it.

Failed Payments: If a payment fails, we may retry the charge and/or suspend access to paid features until payment is resolved.

6. Intellectual Property

All content, design, code, and branding of InbXr are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

You retain ownership of any email content or data you submit for analysis. By using the Service, you grant us a limited, non-exclusive license to process your submitted content solely for the purpose of providing analysis results.

7. Service Availability

We strive to keep InbXr available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as-is" and "as-available" basis.

We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for any downtime, data loss, or interruptions caused by factors beyond our reasonable control.

We do not offer a Service Level Agreement (SLA). For critical email infrastructure needs, we recommend using InbXr alongside your own monitoring systems.

8. Limitation of Liability

To the maximum extent permitted by law:

• InbXr is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for email deliverability outcomes. Our tools provide analysis and recommendations, not guarantees.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability is limited to the fullest extent permitted by applicable law.

9. Termination

You may terminate your account at any time by contacting us or deleting your account from your Account settings.

We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:

• Violation of these Terms of Service
• Abusive or fraudulent activity
• Non-payment of subscription fees
• Extended inactivity (accounts inactive for over 12 months may be deleted)

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that analysis results are complete, accurate, or current. Email deliverability depends on many factors outside our control, including recipient server configurations, sender reputation, and content filtering algorithms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of competent jurisdiction within the United States.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
